Court Injunctions Against One Way Sport OY Dismissed by Courts in Germany and Finland

April 23, 2012 – Despite several attempts by Austrian ski company Fischer Sports GmbH to claim unfair competition and trademark rights due to ONE WAY Nordic’s use of black and yellow on its premiere line of Nordic skis and boots, the German and Finnish court systems have both unanimously rejected three separate claims by Fischer Sports GmbH against ONE WAY.

“We feel vindicated by the outright rejection of the courts of Fischer’s claims. These claims are baseless and simply without merit.  Fischer does not own the black and yellow colours for Nordic skis and boots, nor do they have any legal trademarks in place for black and yellow skis and boots,” says Andreas Bennert, CEO/ Managing Director of ONE WAY Sport OY, Finland.

ONE WAY Sport will continue to vigorously defend all claims in both Germany and Finland in the next month, and will be seeking significant compensation from Fischer Sports GmbH for damages caused to its brand and sales during the injunction. “We are confident in our case against Fischer, and will aggressively pursue compensation from losses in sales sustained during the court injunction, and damage to our brand’s integrity during the time when these baseless claims were in force,” states Mr. Bennert.
